General Terms and Conditions

§ 1 Scope

The following terms and conditions apply to all orders placed via our online shop by consumers and businesses. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Contracting Party, Conclusion of Contract

The purchase contract is concluded with HatiHati Studios GmbH, Heckscherstraße 1a, 20253 Hamburg, Germany.

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the order button, you place a binding order for the goods in your shopping cart. Confirmation of receipt of your order is sent by e-mail immediately after the order is submitted and does not yet constitute acceptance of the contract. The contract is concluded when we accept your order by sending a shipping confirmation or by delivering the goods.

§ 3 Contract Language

The contract can be concluded in German and English.

§ 4 Prices and Shipping Costs

The prices stated on the product pages include statutory VAT and other price components. In addition to the stated prices, shipping costs may apply, which are shown separately during the order process.

§ 5 Payment

Payment can be made via Shopify Payments (credit card), PayPal, Klarna, as well as Apple Pay and Google Pay. The payment methods displayed during the order process apply. If you select a payment service provider, its terms apply additionally.

§ 6 Delivery

Delivery is made within the delivery times stated in the shop to the delivery address you provide. We deliver to the countries selectable during the order process. The shipping service provider is Hermes.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Right of Withdrawal

Consumers have a statutory right of withdrawal, about which we inform in our withdrawal policy.

§ 9 Warranty

Statutory warranty rights apply.

§ 10 Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the consumer's country of habitual residence is not withdrawn. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
